This EPA Compliance & Restricted Products Policy outlines the specific regulatory framework we operate under, the restricted products we sell, the certification requirements for purchasers, and our compliance verification and record-keeping procedures. By purchasing regulated refrigerants from hometafy, you acknowledge and agree to comply with all applicable environmental regulations.
1. Regulatory Framework — Section 608 of the Clean Air Act
The sale and handling of refrigerant gases in the United States are governed primarily by Section 608 of the Clean Air Act, as amended. This federal law establishes the legal requirements for the purchase, use, recovery, recycling, and disposal of ozone-depleting substances and their substitutes. Under Section 608, it is illegal to sell regulated refrigerants to any person who does not hold a valid EPA Section 608 Technician Certification. hometafy strictly enforces this law as a condition of every refrigerant transaction.
2. Restricted Products
The following categories of products offered on hometafy.com are subject to restricted sale under our EPA compliance program. This list is not exhaustive and may be updated as federal regulations evolve:
- Hydrofluorocarbon (HFC) refrigerants: Including but not limited to R-410A, R-134a, R-32, R-404A, R-407C, R-507, and R-513A. These are governed by the American Innovation and Manufacturing (AIM) Act's phasedown schedule.
- Hydrochlorofluorocarbon (HCFC) refrigerants: R-22 (also known as Freon). New production of R-22 was banned as of January 1, 2020, under the Montreal Protocol phase-out. We offer only certified reclaimed R-22 that has been processed to meet AHRI Standard 700 purity specifications.
- Blended refrigerants: Any regulated blended compound containing HFC or HCFC components, such as R-407C and R-404A.
3. Purchaser Certification Requirements
To purchase any regulated refrigerant from our website, you must satisfy the following requirements:
- Age: You must be at least 18 years of age.
- EPA Section 608 Certification: You must hold a valid, unexpired EPA Section 608 Technician Certification appropriate to the type and quantity of refrigerant you are purchasing. The certification must be issued by an EPA-approved certifying organisation.
- Certification levels: Different certification types (Type I, Type II, Type III, or Universal) may be required depending on the specific refrigerant and the equipment in which it will be used. We recommend confirming with your certifying body that your certification covers the products you intend to purchase.
- Verification: You must provide your certification number and submit a clear digital image of your certification card during the checkout process. Our compliance team manually verifies each submission before the order is released for dispatch.
4. Certification Verification Process
Our EPA compliance verification process is designed to be thorough yet efficient, minimising delays while ensuring full regulatory compliance:
- Submission: During checkout, you will be prompted to upload a clear image of your EPA Section 608 certification card and enter your certification number.
- Manual review: Our compliance team reviews the submitted documentation within business hours. We verify that the certification is current, that the name on the certification matches the name on the order, and that the certification type covers the refrigerants being purchased.
- Approval or follow-up: If the documentation is valid and complete, the order is approved for processing. If the documentation is unclear, expired, or insufficient, our team will contact you via email to request corrected or additional information.
- Dispatch: Orders are released to our warehouse for packing and dispatch only after certification verification is successfully completed.
We reserve the right to refuse sale to any individual or entity that fails to provide valid, verifiable certification documentation. If an order is refused due to inadequate certification, any amount charged will be refunded in full.
5. R-22 (Freon) — Special Conditions
Due to the federal phase-out of ozone-depleting substances under the Montreal Protocol, the production and importation of new (virgin) R-22 have been illegal in the United States since January 1, 2020. Under EPA regulations, R-22 may still be sold only as reclaimed refrigerant that has been recovered from existing systems, processed to AHRI Standard 700 purity specifications, and certified as such. All R-22 offered on hometafy.com is certified reclaimed material. We clearly label each R-22 listing with its reclaimed status and provide the applicable purity certification documentation.
6. Prohibition on Venting
Under Section 608 of the Clean Air Act, it is a federal offence to knowingly vent or release refrigerants into the atmosphere during the installation, service, repair, or disposal of air conditioning and refrigeration equipment. hometafy strictly prohibits the sale of our products to individuals or entities known to violate these venting prohibitions. We reserve the right to refuse sales, revoke purchasing privileges, and report violations to the EPA Enforcement Division if we become aware of illegal venting activities by any customer.
7. Record Keeping and Reporting
In compliance with EPA regulations governing the sale of regulated refrigerants, hometafy maintains detailed, auditable records of every refrigerant transaction. These records include — but are not limited to — the following information for each sale:
- Purchaser's full name and business name
- Purchaser's EPA Section 608 certification number and documentation
- Date of transaction
- Specific refrigerant compound, quantity (weight), and container type sold
- Shipping address and delivery confirmation with adult signature
These records are retained for the full period required by federal regulation, which may extend several years from the date of transaction. Records are made available to the EPA upon lawful request.
8. Penalties for Non-Compliance
Violation of EPA Section 608 regulations — including purchasing regulated refrigerants without valid certification, knowingly providing false certification information, venting refrigerants, or selling regulated products to uncertified individuals — can result in significant civil and criminal penalties, including fines of up to $37,500 per day per violation and potential criminal prosecution. hometafy takes these obligations extremely seriously and expects the same commitment from every customer.
