These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and HOMETAFY LLC ("Company," "we," "us," or "our") governing your access to and use of the hometafy.com website (the "Site") and the purchase of any products, particularly DOT-regulated pressurized materials such as refrigerants. By accessing the Site or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any provision, you must immediately cease using the Site.

1. Eligibility and Acceptance

By using our website and purchasing our products, you represent and warrant that you are at least 18 years of age, you are a licensed or certified HVAC professional or a business entity employing such professionals, and you possess the full legal authority to enter into these Terms. If you are using the Site on behalf of a business entity, you represent that you are authorised to bind that entity. If you do not meet these eligibility requirements, you must not use our Site or purchase our products.

2. Account Registration

To place an order for regulated refrigerants, you may be required to create an account. You agree to provide accurate, current, and complete account information and to update it promptly if it changes. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate any account that provides false or incomplete information.

3. EPA Compliance and Purchasing Restrictions

You acknowledge and agree that the purchase of regulated refrigerant gases — including but not limited to R-410A, R-134a, R-22, R-32, R-404A, R-407C, and other compounds covered under Section 608 of the Clean Air Act — is strictly regulated by the United States Environmental Protection Agency (EPA).

  • By placing an order, you expressly certify that you hold a current, valid, unexpired EPA Section 608 certification appropriate to the type of refrigerant being purchased.
  • We reserve the right to refuse, cancel, or delay any order if valid certification cannot be verified through our compliance team. If certification verification is unsuccessful, you will be notified and any amount charged will be refunded in full.
  • It is a federal offence to provide false certification information or to purchase regulated refrigerants without a valid EPA certification. You agree to indemnify and hold hometafy harmless against any fines, penalties, or legal expenses incurred as a direct or indirect result of false representations made by you.

4. Product Descriptions and Pricing

We make every effort to display our products, specifications, and prices accurately. Product descriptions, technical data, and pricing are subject to change without notice based on manufacturer updates, market availability, and raw material costs. We do not warrant that product descriptions, pricing, or any other content on the Site is fully accurate, complete, reliable, current, or error-free. In the event of a material error, we reserve the right to correct the error and cancel any affected orders with a full refund.

5. Order Acceptance and Contract Formation

Your submission of an order constitutes an offer to purchase the products listed in your cart. All orders are subject to acceptance by us and are contingent on product availability. We reserve the right to refuse or cancel any order for any lawful reason, including but not limited to: product unavailability, errors in product or pricing information, inability to verify your EPA certification, or suspected fraudulent activity. A legally binding contract is formed only when we send you an order confirmation email. If we cancel an order after accepting it, we will notify you and issue a full refund to the original payment method.

6. Payment Terms

We accept major credit cards, debit cards, and other payment methods as indicated at checkout. You represent and warrant that you are authorized to use the payment method you provide. 7. Shipping, Risk of Loss, and Delivery

Our Shipping Policy governs the shipment of all products. Risk of loss and title for products purchased from us pass to you upon our delivery to the carrier. We are not responsible for delays caused by the carrier, weather, or other circumstances outside our reasonable control.

8. Returns and Refunds

Our Returns & Refunds Policy governs all returns, exchanges, and refunds. Due to the regulated nature of refrigerant products, only unopened, factory-sealed cylinders in original condition may be returned within 30 days of delivery. Opened or used cylinders cannot be accepted.

9. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall hometafy, its officers, directors, employees, affiliates, or agents be liable for any direct, indirect, incidental, special, consequential, or exemplary damages — including but not limited to lost profits, lost revenue, lost business opportunity, loss of data, or cost of substitute goods — arising out of or in connection with these Terms, the use of the Site, or the purchase or use of any product, even if we have been advised of the possibility of such damages. Our total cumulative liability for any claim arising out of these Terms or your use of the Site is strictly limited to the purchase price paid by you for the specific product that is the subject of the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless hometafy, its officers, directors, employees, and agents from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of or inability to use our products; (b) your violation of these Terms; (c) your violation of any applicable law or regulation, including but not limited to EPA rules governing refrigerant handling and disposal; or (d) your infringement of any right of a third party, including intellectual property rights.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States of America, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach thereof shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved within 30 days of written notice, either party may initiate binding arbitration administered by a recognised arbitration service in accordance with its commercial rules. The arbitration shall take place in Colorado. Each party shall bear its own legal fees and costs.

12. Entire Agreement and Severability

These Terms, together with our Privacy Policy, Shipping Policy, Returns & Refunds Policy, EPA Compliance Policy, and any order confirmation issued to you, constitute the entire agreement between you and hometafy regarding your use of the Site and purchase of products. If any provision of these Terms is found to be unenforceable or invalid by a court or arbitrator of competent jurisdiction, that provision shall be severed and the remaining provisions shall remain in full force and effect.
